Firm Wins $600 Million Appeal for Planned Parenthood

Concluding a six-year, bet-the-business battle in a whistleblower lawsuit against several Planned Parenthood affiliates, the Firm prevailed before the United States Court of Appeals for the Ninth Circuit.  In a unanimous decision, the Ninth Circuit held that the plaintiff, a former Planned Parenthood CFO, had failed to allege “a plausible claim that Planned Parenthood knowingly made false claims.”  The court concluded that the plaintiff’s claims were “contradicted by a series of letters he attached to the complaint” that “fatally undercut” his fraud allegations.  The plaintiff had alleged that Planned Parenthood had submitted false claims to the government worth hundreds of millions of dollars from 1997 through 2004.
